The website and learning management system (LMS) operated by 10930130 Canada Inc. (hereinafter referred to as “Train Food Safety”) under the domain name trainfoodsafety.ca is available for use under the condition that you agree to these terms of use. By using the website and accessing the course you are signifying your agreement to be bound by these terms.

You may use the website only if you are a resident of Canada, have reached the age of majority where you live and you can form legally binding contracts under applicable law. You may not use the Website if you live in a jurisdiction where access to or use of the Website or any part of it may be illegal or prohibited. It is solely your responsibility to determine whether your use of the Website is lawful, and you must comply with all applicable laws. Train Food Safety reserves the right to request proof of identification and age and has the right to refuse any transaction or access based on our discretion.

Train Food Safety grants You a limited, personal, non- sublicensable, non-transferable, royalty-free, nonexclusive license to access and use the LMS, content and services for 30 days from the date or purchase. Train Food Safety reserves the right to cancel or terminate any order for any reason.

None of the content found on www.trainfoodsafety.ca or the online course may be reproduced, republished, reverse engineered, retransmitted, resold, distributed, displayed, sold, transferred, or modified in any form without the express written permission of CHIMA or the applicable Third Parties. You may not sell or resell any part of the Website or access to the Website. You may not use any of the software that is used in the operation or provision of the Website except while you are using the Website in accordance with this Agreement.

Registrants have 5 business days from the date of purchase to request a refund. To request a refund, please send us an email at info@trainfoodsafety.ca with your First Name, Last Name, and reason for your request.

A refund will not be given if:

1. The registrant / candidate has logged into the course
2. The registrant / candidate does not meet the Course Eligibility requirements set out above
3. The registrant / candidate had requested a refund after 5 business days from the date of purchase
4. The registrant / candidate failed the online exam
5. The registrant / candidate is requesting a refund due to their computer, speaker or camera not working properly
6. The registrant / candidate did not comply with the test-taking procedures laid out by our 3rd party proctoring service

Train Food Safety endeavours to provide the most updated and accurate information on its website and online course, however, errors and inaccuracies may sometimes occur. Train Food Safety reserves the right to (a) correct any errors at any time without notice or liability to you or any other person; (b) change at any time the services, prices, fees, and specifications of any products or promotional offers on the website.

The registrant is fully responsible and liable for the security of their login credentials including their username and password and any use or misuse of this information. You will keep the information secure and confidential and will not permit any other person to use their login credentials. We are not responsible for any unauthorized activity performed under your account.

Train Food Safety does not accept or consider solicited or unsolicited ideas or suggestions (“Feedback”). You automatically grant (or warrant that the owner of the Feedback grants) Train Food Safety and its successors, assigns and licensees a perpetual, royalty-free, irrevocable, unrestricted, non-exclusive, world-wide, assignable, sub-licensable, right and license to use and exploit the Feedback or any ideas, concepts, know-how or techniques associated with the Feedback for any purpose whatsoever, commercial or otherwise, using any form, media or technology now known or later developed, without providing any attribution or compensation to you or any other person, without any liability whatsoever, and free from any obligation of confidence or other duties on the part of Train Food Safety or its successors, assigns and licensees, and you agree, represent and warrant that all moral rights in the Feedback are waived in favour of Train Food Safety and its successors, assigns and licensees.

You agree that Train Food Safety shall have no liability whatsoever for any use You make of the website or online course. You hereby agree to indemnify and hold harmless Train Food Safety from any and all damages, liability, costs, and expenses (including attorney’s fees) arising from claims related to Your use, and Your customers’ use of the course.

Under no circumstances and under no legal theory, tort, contract, strict liability, or otherwise, shall Train Food Safety or its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, work stoppage, accuracy of results, goodwill, or other intangible losses, resulting from Your use of the online course, website, or learning management system.
